- CIMB Bank Berhad CIMB Islamic Bank Berhad (13491-P) (671380-H) TERMS AND CONDITIONS GOVERNING CIMB & UNICEF DONATION REDEMPTION CAMPAIGN (“Campaign”) Campaign Period 1. The Campaign is jointly organized by CIMB Bank Berhad (13491-P) and CIMB Islamic Bank Berhad (671380-H) (“CIMB” or “the Bank”) and UNICEF Malaysia (“UNICEF”) and will be held th th from 6 June 2017 to 30 September 2017, both dates inclusive (“Campaign Period”). CIMB reserves the right upon giving prior notice of not less than fourteen (14) calendar days to change the duration and/or the commencement and/or expiry dates of the Campaign Period. Eligibility 2.. The Campaign is open to all CIMB principal Credit Cardholders under CIMB’s Member Rewards Programme (“Eligible Cardholder(s)”) excluding Cash Rebates and Enrich Co-Brand credit card holder. Qualifying Criteria and Campaign Mechanics 3. Under the Campaign, Eligible Cardholder(s) may utilise their accumulated bonus points under CIMB’s Member Rewards Programme (“Bonus Points”) to redeem the Product Item set out in Clause 4 of these Terms and Conditions. 4. Eligible Cardholder(s) may redeem their Bonus Points to purchase the following products of UNICEF under the Campaign: Product Product Description Bonus Points to Purchase Product Product 1 17 doses of Polio Vaccine to protect children from polio.RM20 is the cost to purchase 17 doses of Polio Vaccine and have it administered to children. 8,000 RM20.00 Product 2 44 doses of Polio Vaccineto protect children from polio.RM50 is the cost to purchase 44 doses of Polio Vaccine and have it administered to children. 20,000 RM50.00 Product 1 and Product 2 are collectively referred to as “Product Item”. Eligible Cardholder(s) may redeem their available Bonus Points to purchase the Product Item of UNICEF via CIMB website at http://rewards.cimbbank.com.my/ or through CIMB Contact Centre Tel: +603-6204 7788. The redeemed Bonus Points will be deducted from the Eligible Cardholder(s)’ credit card account balance, converted into value in Ringgit Malaysia and paid to UNICEF. 6. Purchase of the Product Item under the Campaign can only be made by redeeming the Bonus Points and no cash donation can be made under the Campaign. 7. Upon the successful redemption of Bonus Points by the Eligible Cardholder(s), UNICEF will send a short message service (“SMS”) acknowledgement to the Eligible Cardholder(s) within 14 working days from the Eligible Cardholder(s)’ redemption in the manner as specified in Clause 5 of these Terms and Conditions. For the avoidance of doubt, the redemption is considered to be successful when the SMS is sent to the Eligible Cardholder(s). 8. It shall be the Eligible Cardholder(s) responsibility to ensure their mobile numbers (“Contact Particulars”) with CIMB are current and updated. In the event there is a change to the Contact Particulars it shall be the responsibility of the Eligible Cardholder(s) to update CIMB of the same. CIMB shall not be responsible to the Eligible Cardholder(s) for any loss suffered or incurred in the event the Contact Particulars maintained in CIMB’s record is not current or correct. 9. Any Bonus Points redemption made to purchase the Product Item of UNICEF under this Campaign is not eligible for tax exemption and as such no tax exemption letter will be issued. 10. Any redeemed Bonus Points under this Campaign are strictly not reversible, refundable, exchangeable, replaceable or transferable for cash or credit. General Terms and Conditions 11. Eligible Cardholder(s) hereby give their consent to and authorise CIMB to use and/or disclose their particulars to a third party including UNICEF and its representatives for the purposes of this Campaign. The disclosure shall be limited to the Eligible Cardholder(s)’ name, mobile telephone number and the value of the redeemed Bonus Points (in points and Ringgit Malaysia value) which shall be used only in relation to and for the purposes of the Campaign. 12. Every time Eligible Cardholder(s) redeem their Bonus Points to purchase the Product Item under this Campaign, the Eligible Cardholder(s) directly enter into an agreement with UNICEF. CIMB and its online catalogue only provide the access and the technical platform for the Eligible Cardholder(s) to redeem their Bonus Points to purchase the Product Item. The Eligible Cardholder(s) agree and acknowledge that separate terms and conditions of UNICEF will apply to the purchase of the Product Item. Eligible Cardholder(s) agree to abide to such applicable terms and conditions. CIMB shall not become a party to the transaction between the Eligible Cardholder(s) and UNICEF. CIMB strongly recommends that the Eligible Cardholder(s) check the terms and conditions of UNICEF prior to redeeming their Bonus Points to purchase the Product Item. 13. By participating in this Campaign, the Eligible Cardholder(s) is deemed to have read, understood and agreed to be bound by the Terms and Conditions herein and agree that any and all decisions made by CIMB in relation to every aspect of this Campaign shall be final and conclusive provided

CIMB shall not be responsible or held liable in any manner whatsoever in respect of technical failures of any kind, whatsoever intervention, interruptions and/or electronic or human error in the administration and/or processing of any of the transactions relating to the Campaign unless the same is due to the gross negligence or willful default of CIMB. 15. CIMB reserves the right to cancel, terminate or suspend the Campaign upon giving notice of not less than fourteen (14) calendar days. For avoidance of doubt, any cancellation, termination or suspension by the Bank of the Campaign shall not entitle the Eligible Cardholder(s) or any other persons whatsoever to any claim or compensation against the Bank for any losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension of the Campaign. 16. CIMB reserves the rights upon giving at least twenty one (21) calendar days prior notice to vary whether by addition, deletion, modification, amendment or otherwise howsoever (“the Amendment”) any of the terms and conditions herein. The Amendment to the provisions herein shall be binding on the Eligible Cardholder(s) and CIMB is deemed to have brought to the attention of the Eligible Cardholder(s) by (i) its display at CIMB’s premises and website regarding the Amendment where detail provisions regarding the Amendment may be provided in the notice itself or may be provided to the Eligible Cardholder(s) upon request; or (ii) by ordinary mail to the Eligible Cardholder(s) last known address or (iii) advertised in one newspaper of CIMB’s choice; or (iv) by electronic means such as Short Message Services (SMS) and/or e-mail or any other mode of notification as CIMB deems fit and the Amendment shall be deemed binding on the Eligible Cardholder(s) as from the date of notification of the Amendment or from such other date as may be specified by CIMB in the notification. 17. These Terms and Conditions are in addition to the CIMB Cardholder Terms and Conditions and Member Rewards Programme Terms & Conditions applicable to the Eligible Cardholder(s). In the event of any inconsistency or conflict between these terms and conditions and the said Terms and Conditions, these terms and conditions shall prevail in so far as they relate to the Campaign but not otherwise. 18. The Eligible Cardholder(s)’ credit card account(s) (i) MUST not be in breach of the terms and conditions governing the credit card account(s) AND (ii) MUST not be terminated or closed or be made subject to any attachment, adverse orders made by the Court or any authorities sanctioned by laws, delinquent, and/or be invalid or cancelled as determined by CIMB, otherwise the Eligible Cardholder(s) will be disqualified from participating in this Campaign. 19. CIMB does not warrant that this Campaign shall not be uninterrupted and/or error free. By participating in this Campaign, the Eligible Cardholder(s) hereby acknowledges and irrevocably agrees that CIMB shall not in any manner whatsoever be liable for any technical failures of any kind, whatsoever intervention, interruption and/or any electronic error arising from this Campaign unless the same arise from and are caused directly by CIMB’s gross negligence or willful default. 20. CIMB shall not be liable or held responsible to the Eligible Cardholder(s)in any manner whatsoever if CIMB is unable to perform any of its obligations stipulated herein where such inability is due directly or indirectly to any Act of God, industrial dispute, war, strike, riot, technical or system failures or anything beyond CIMB’s reasonable control.

By participating in this Campaign, the Eligible Cardholder(s) hereby agree and irrevocably and unconditionally undertake to fully absolve CIMB of all liabilities and agrees to indemnify CIMB (on full indemnity basis) and hold CIMB harmless against any claim by any third party and against any loss, damage, cost or expense (including solicitors’ fees and cost) that CIMB may suffer or incur as a result of or in connection with this Campaign unless the same arise from and are caused directly by CIMB’s gross negligence or willful default. 22. CIMB accept no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected redemption or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise. 23. CIMB, subsidiaries, affiliates and associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Campaign. 24. The terms and condition contained herein shall prevail over any inconsistent terms, conditions, provisions or representation contained in any other promotional or advertising materials for the Campaign. 25. If there is any inconsistency, conflict, ambiguity or discrepancy between the Bahasa Malaysia and English version or other language version of these terms and conditions, the English version of these terms and conditions shall prevail. Notwithstanding the aforementioned where request had been made by the Eligible Cardholder(s) and noted and acknowledged by CIMB in its records that the Bahasa Malaysia version of the terms and conditions shall govern the CIMB’s Credit Card(s), then the Bahasa Malaysia version of the terms and conditions herein shall prevail. 26.
