Bai‘ al-‘ariyah
Definition of "Bai‘ al-‘ariyah"
A sale deal of fruit-on-the trees (usually dates) in which some trees in the garden are not part of the sale deal but are donated by the owner to the poor who can exchange fresh fruit of these trees for dry fruit (dates) for their household consumption and not for further sale. This type of deal is an exception to the general law of sale which prohibits exchange of fresh fruit for dry fruit. It is also known as bai‘ al- ‘arayah.
