Sale of Debt: Scope & Shariah Ruling
This Standard deals with the sale of the debt to the debtor and its sale to a third party, i.e., a party other than the debtor.
This Standard] does not deal with (i) the discharge of debt (istifa’ al-dayn) by the debtor, whether in full or in part, if it does not take place through a commutative arrangement nor with (ii) novation (hawala) or (iii) set-off (muqasa), since there is a separate standard for both.
