The legitimacy of Istisna’a is based on the request of the Prophet (peace be upon him) that a pulpit (a platform) for preaching and a finger ring be manufactured for him. An Istisna’a contract is also permissible on the basis of the principle of Istihsan (Shariah approbation), the general principles of contracts and transactions and the objectives of Shariah. The Istisna’a is a binding contract and not a mere promise. The International Islamic Fiqh Academy has issued a resolution in support of the legitimacy of Istisna’a.
