The basis for the permissibility of Musaqat is the Sunnah, Ijma’ and common sense. From the Sunnah, there is the Hadith narrated by Ibn Umar that the Prophet Muhammad (peace be upon him) gave the land of Khaybar to its inhabitants to work on and cultivate in return for half of its yield (fruits and plants).
