Ijarah Fasidah

Definition of "Ijarah Fasidah"

Lit: Voidable contract of tenancy. Tech: A contract of land tenancy is voidable if one of the following items are not exactly specified in it: (i) size, quality and location of the land; (ii) use to which the land would be put; (iii) duration of the tenancy; and (iv) amount of the rent. The contract of tenancy also becomes voidable if it contains stipulations that constitute one-sided charges to the advantage of either party.
